Yeah, she filed a police report and eventually dropped the charges. For years, she refused to talk about it. But in theory (?) there's documentation.

It looks like she's actually denied this before - though not as categorically - back in 1989, in a Rolling Stone interview. It's certainly possible that this story falls into the category of a tabloid story/rumor that has taken on a life of its own over the course of 30 years, a la the Janet Jackson secret baby story. And, it's definitely a huge can of worms to open if the story is true. However, if the existence of a police report was fabricated by Taraborrelli in his Madonna biography, Penn is going after the wrong target. It's the alleged existence of a police report and quotes from police officers that have helped to legitimize the story.

I don't know what to think about this. I guess I should just take Madonna at her words. Is it possible it was sex play that went wrong? Or something with more blurred lines than straight up assault?
People very easily believe that Penn attacked her. His history of resorting to violence against Paps has made that believable. But if she is the one who was allegedly attacked and who is now claiming it didn't happened, shouldn't we take her at face value?
I know victims lie all the time, but it's been years and years since the incident. Why would she lie now in an affidavit?

I remember reading about the incident in my mom's People magazine when it happened. I couldn't have been more than 13 or 14. Something explosive definitely happened at the end of their marriage and the police were involved.
Why she chooses to associate with him and cover for him now is her business, but back then he had a reputation for beating up photographers and no one seemed to doubt that he hurt his wife. He's always been a violent, arrogant asshole.

I don't know the law, but hopefully when it comes to Lee Daniels, he doesn't need to prove that Sean actually did it, he just needs to prove there was a well-known incident involving the police.

I had to go back and read the specifics about why Penn is suing Daniels because I'd forgotten. This is the offending statement:
I realize that Terrence Howard has been arrested more times for domestic violence. But in Daniels' quote, he doesn't specifically mention domestic violence. In general, Sean Penn is a hot head who has resorted to violence lots of times. The specifics may differ, but he's hardly the picture of an emotionally healthy adult. I think the whole thing is an ugly gray area but I don't think Madonna's accusation that Penn beat her is the single thing that's responsible for creating his bad reputation. . This is kind of similar to Lindsay Lohan's offense at Jennifer Lawrence statement, IMO. Both statements were in poor taste but there's still a lot of truth in there.
