She's supposed to have stated on the record that her ex deals weapons/drugs, and that got his visa yanked. I'm not aware of any evidence that he actually does. So, yeah, it's hard to sympathize with her when she does stuff like refusing to put her ex's name on their daughter's birth certificate.

And I believe the sole reason why he gets primary custody is the fact she can travel freely, whereas he can't visit the US due to her. So if the kids where to remain in the US per her wishes, yeah, you can bet parent alienation would certainly take place.

The situation is so weird. At one point she was claiming domestic violence and destruction of property against him. Then she got him deported by claiming that he was dealing guns (it would have to be somewhat true for him to be deported, yes?). Then the custody stuff happened. Judges have told her to do certain things, like put the father's name on her kids' birth certificates to help her case, but she refuses. And she has been claiming that she can't afford to travel to France to visit her kids. It's a giant mess.
At the same time, why don't they live with her, and then travel to France for visits? Why does he get the kids the majority of the time?

Hamatron, you'd think it would take more than an allegation to revoke a visa, but it doesn't. Not under the Patriot Act. Saying he was dealing guns to enemies of the US was an immediate revocation and deportation.

She tried to get sole custody of them, and since her ex would not be allowed to enter the country, parental alienation was feared. She can travel freely, and her ex is going to be paying for those six plane tickets and a place for her to stay when she comes to France.

You would think they would want to investigate anyway, as discovering a criminal can lead to finding other criminals and potentially taking down rings. But I guess we're lazy about that these days.

The first I ever heard of her, she was on the cover of Instyle's Wedding Issue (remember those), and before the magazine had hit the stands, she'd left her husband because she couldn't deal with his newly discovered cancer. That's all I need to know about her. I'm sure the kids are better off without her influence.

Has anything criminal or shady ever been proven about her ex? She got him kicked out of the country for dealing drugs/weapons but did this go any farther than her accusation? It's hard to feel bad for her because it seems like she was trying to cut the dad out of the kids lives by getting him deported. Now it's come back to bite her. I know appearances can be deceiving but all pics I've seen of this guy he looks like a kid barely out of high school and definitely not an international gun/drug runner.

According to Kelly's Wikipedia page:
Also, damn, this is cold:
Also, this is a big drama fest, but apparently Giersch's deportation will be reconsidered in 2 years. So he might make it back in the U.S. yet. Meanwhile, Kelly is $2 million in debt in legal fees. Yikes.
