Exactly. And if her ex were really that unstable and if she really cared about the kids, then why didn't Melissa take the kids with her when she left?

Most of the time you can't take kids out of their home when leaving, even if it is with a parent. The ex-husband of a friend of mine tried to take their kids with him when he left (just because he wanted to), she told him to fuck himself, called the cops and the cops said there was no way in hell he could take them out of their home without a court order. Who knows. But, yeah, if Tammy really was that unstable I'm sure Melissa could get a court order ASAP and take them kids out in the blink of an eye. Melissa's apparently just your run of the mill asshole.

I keep seeing different things reported. Were Melissa and Tammy's kids "done" (sorry, my brain is fried) with a surrogate? I saw that reported somewhere and I thought Tammy had carried them. Quite a while ago I remember reading her blog here and there and I think she mentioned something about breastfeeding... Then the references of Tammy's blog where she said Melissa was going to wait until she was done with the tour to file for divorce. I know people have said, "Well, obviously she knew it was going to happen, then!" But maybe Melissa agreed to think about it while she was on tour and then file for it if she still wanted to do it when she got back. That might be what Tammy's upset about...?

Still. Not paying for your kids? Dick move.

If there is a new woman in Melissa's life, she should expect that they'll have two kids, and then Melissa will abandon her and try to weasel out of supporting their kids. Third time not a charm.

That's my recollection too, and that Melissa was very upset about it. But they worked it out to the point that they had houses net to each other that shared a backyard so they could both be with the kids.

Interesting interview with Melissa, Julie and the Crosbys weird to note that J/M broke up about year after this.

Tammy birthed their kids with the aid of an anonymous sperm donor. Julie Cypher also birthed her kids with Melissa, with David Crosby as a sperm donor. I can't remember seeing anything about Melissa donating any of her own eggs to any of the conceptions, so I'm assuming she's not genetically related to any of her children.

From a legal standpoint, does the fact that Melissa may not be genetically related to the kids affect her custody rights and support obligations? In a situation like this, would a non-bio parent legally adopt the kids to establish legal rights and obligations to them?

Generally, I think the non-bio parent legally adopts the kids. There have been cases where the bio-parent has used the fact that they are the only bio-parent as leverage to keep the kids away from the non-bio parent. There's a case going on right now with issues like that which has been going on for years, the bio-mom renounced homosexuality and became an evangelical christian. The non-bio mom hasn't seen her daughter since November and there's speculation that bio-mom fled the country with the child.

So basically, this looks like it's going to be a big ol' mess of a case. Lawyers will be getting rich off this one.
