...mostly I'm surprised a multimillion (billion?) dollar company like Duane Reade wouldn't have an army of lawyers to avoid anything even remotely smelling litigious.
And from the people weighing in on this thread, DR could still have gotten the free publicity from a K. Heigl photo while easily/completely avoiding any nasty legal entanglements. Just seems like such unnecessary risk for them. Retweet the photo without the caption, problem solved. Oy.

The mistake was made at an intern-esk level, I reckon. I can see them paying their lawyers $1000 an hour, but hiring an intern at slave wages to run their twitter feed. So you get a 20 yo NYU student that thinks this pap pic with the quote is hilarious...then they get sued.

I read that she did ask them to take down the picture, but they refused. Hence, lawsuit.

One for the Money is on TBS. I remember this book being tons better than this mess. ETA: She was "taken by surprise and angry at her career for betraying her". CelebitchyOh yeah, One for the Money the book, though it's cheesy, was fun and had GREAT potential for a movie adaptation. But the movie was terrible! I'm just so relieved that she didn't end up playing Claire in Outlander as she claimed she was considering doing.

Please, Hollywood, stop with the "romcom queen" quest. That era of the handpicked "all-american girl" acting adorable in movie after movie is over. It died when Julia Roberts decided to openly let her bitch flag fly and her heir Sandra Bullock moved on to dramas and grossout comedy. Katherine Heigl is one of a long list of actresses who have been propped up as the next one-note romantic comedy chick who has failed at it. The world has moved on and it's not a box actresses want to be trapped in anymore if they can avoid it.
