This one seems to be a slam dunk for Satriani. I think Coldplay shouldn't even have released their statement and simply let the courts decide. I can see how realizing that your biggest hit in years is going to pay out to someone else (and least in part) has gotta sting, but come on. Musicians have lost plagiarism suits for far, far less.

Oh, I agree with that. I mentioned up-thread that I heard the same riff in a Cat Stevens song. The tune is just one part of the problem though. The thing is, I don't think it would do much good for Coldplay to argue "He stole it first!" or "it's a really common riff" for two reasons.
First, it would take a lot of time and organisation and a shit load of money in legal fees to organise a recorded history of the song in their defence and it would piss far too many people off and involve others who may not want to be dragged into it. The only people who would look forward to that scenario are their attorneys.
And second, it is not just the riff that is similar to Joe's song. Or the just the chord line. Or just the melody. It is all those things - and it is rhythmically identical. It can't really be claimed it has even a "we made it our own"-American-Idol-style stamp of individual originality, because long segments of the Coldplay song simply is Joe's song with a faster tempo. And the a problem because they are making money off of it. It is more than likely than not that it actually is unconcious plagiarism.
I wouldn't be surprised if the song was playing in Wholefoods when Chris was buying argula and macrobiotic salad dressing, he hummed along for a second, but gave it nary another thought because little Apple knocked over a case of Fiji water.... and 2 years later the song was written.
Toss him some cash and a songwriting credit and everyone is happy. Hell, Chris Martin won't even notice the money is gone.

Oh I know that isn't a good defense. I'm just kinda amused by reading the fan responses to all this. Both sides seem 100% convinced their artist created this riff when it's becoming more and more clear that isn't the case.
I agree that it's more than likely unconscious plagiarism. Though that seems a bit of a contradiction since plagiarism is supposed to be very deliberate. Maybe the definition needs to be expanded some.
But yeah the best thing to do is probably settle out of court. Give Joe a songwriting credit and share of the profits. Still, I wouldn't necessarily say the case it a slamdunk for Joe. The court system has a tendency to surprise me.

The song is nominated for both record of the year and song of the year for a Grammy. If they win should they thank Joe Satriani? Awk-ward.

Yeah, Martin looks dorky but he also looks like he's having fun with his kids. I can't picture Fishie taking the kids to the park and goofing off with them.
