It never really occurred to me before, and I have seen the version of Dune with Sting in it, and read alot (not all) of the books, just how much George Lucas ripped off Frank Herbert. However this is something that happens in scifi all the time. A lawyer would have to let us all know whether a legal suit would have been possible.
Although, George Lucas suing the producers of Battlestar Galactica (original incarnation, long before that godawful reboot), just screams hypocrite to me

George Lucas literally ripped off every comic and piece of fiction with a space opera ior fantasy theme that was published pre-1970. As much as I love Star Wars, it’s undeniable a syncretic piece of work. Anyway, here’s this interview with Dhani Harrison (son of George the Beatle) on his love of Star Wars.
