One of Deadline's headlines about the case: "Gwyneth Paltrow Tells Utah Court She Screamed “You Skied Into My F-ing Back” At Septuagenarian". Good callout. The plaintiff does seem to be correct that she showed no concern whatsoever about whether he was ok. She says it was his fault, so she was mad. But it is basic decency to ask someone if they are ok, even if it was their fault. Same with a car accident. The plaintiff's lead attorney kept asking Gwyneth questions that weren't really questions, they were just goads to make Gwyneth sound like a huge snob. And then Gwyneth had to rephrase her answer so that she only sounded like a medium snob. That's where the "lost half a day of skiing" came from. I think Apple is supposed to testify this week? She's an adult now. I look forward to seeing exactly how insufferable she is compared to her mother. Maybe she'll surprise me and be lovely.

The plaintiff is on the stand now.
His description of the incident -
He was on the lift chair with four people. Got off and headed off to the right side of the run. Said there was lots of room to ski. "All of a sudden in front of me are two 'slow down' signs." He backed off, saw another sign and thought there were merging trails. [He remembers a lot of details about the ski trail.] Came around corner, just remembers everything was great then heard a blood curdling scream, then BOOM. It was like someone was out of control, going to hit a tree, and was going to die. [Gwyneth is slightly shaking her head and looks bemused, like "what is he saying?"] He got hit in his back so hard, between his shoulder blades, had never been hit that hard, and he was flying. "All I saw was a whole lot of snow and sky." Flying and had no control. Said he lurched and put his arms in front of him (not what the medical experts said, he had to hit on the side to break his ribs) and blacked out. He could hear that there was an angry man near him. Plaintiff couldn't move. The angry man said to him "Do you realize you hit somebody?" Plaintiff's skis were still on and he was thinking "how do I placate this guy?" He kind of panicked and tried to say "I'm sorry." He said he was trying to placate the angry man, not apologizing. He says he was still face down on the ground. (How did he say "I'm sorry"?) Something about a man in green being around who skied off. His friend (Craig, who testified) comes to check on him, he's in pain, and his vision is spinning, sees sparks. Now he's talking about pathways in his brain. His friend is asking him questions. He's still on the ground at this point. Someone jerked him up and abruptly left (who?). Tried to ski down the rest of the trail but his friend Craig told him "you've forgotten how to ski!" The plaintiff's testimony is different than his friend Craig's testimony. Craig said he was in pain so he called ski patrol. Now he remembers a lot of details about the woman from ski patrol who gave him aid.
ETA - When he got off the ski run, he got checked out at the Insta care. He found out it was Gwyneth Paltrow when his friend Craig told him. Says he's not into "celebrity worship" and never said it was cool to be hit by a celebrity (this came up in a deposition).
He's talked a lot about the cognitive changes he's experienced and the way it's affected his relationships with his daughters. He's gotten emotional on the stand. It's very sad. I believe this accident changed his life. The jury has to decide if he or Gwyneth caused it or if there was both were "at fault."
ETA2 - He was asked why he brought the lawsuit, three years after the incident. He said he realized no one believed how serious his injuries were or how they affected him. He wanted an opportunity for damages and there were lots of insults to his value system. Now he's about to be cross examined.

This is a really good summary. The more I hear about the eyewitness testimony, the more holes and contradictions people keep bringing up. More excellent points: -The plaintiff had a number of serious medical and neurological problems prior to the accident, so it's really difficult to make the case that his current medical problems all stem from the accident. (And also, you know, he's 76. Could have a lot to do with things like more forgetfulness.) -He has another daughter who says her father's terrible personality and abusive behavior were around way before the accident. (This seems like a terrible claim to make in a lawsuit - "Someone skied into me so it's her fault I abuse my children now!")

Sounds like just two terrible people running into each other, the fact we get to see that Paltrow isn’t the natural blonde she has always claimed to be is the best part of this whole fiasco.

Ginger, you may be disappointed. I just saw that her attorney will read statements from Moses and Apple. They may not appear in court. I can understand the reluctance to put them on the stand considering the media attention on the trial, plus they are both in school.

Gwyneth said on the stand that Apple was planning to miss school, but Moses would be on spring break. It sounds like it's a time issue. The judge imposed an 8-day time limit on the trial and I read that both sides are struggling to fit their witnesses in, and Gwyneth still has several expert witnesses to call. The order of the testimony in this trial seems to be totally haphazard. It's not plaintiff laying out his case and defendant responding. It's just a jumble of plaintiff, defendant, eyewitness, family and experts all testifying at random.

I am so damned tired of nepo babies taking up space in colleges at the expense of more-qualified students who will actually use their degrees when they graduate.
